WB Rants: Fair Use.

Ladies and gentle-monsters,  we are living in an era where  we get our movies online and our video clips and tv shows as well.   But there is a war going on in this world,  a war over fair-use that is being caused by greedy sites like Youtube over fair-use.    It seems that these sites do not know what fair-use actually is.  As  you know, a lot of moronic people tend to think that using  music or clips from movies or tv  shows is 'copyright  infringement' which it isn't.  It's technically qualified as fair use...I repeat...FAIR USE. For those who don't know...'fair use' counts under freedom of speech and thus is legal. The same problem seems to be plaguing Deviantart as well,  although on  Deviantart the 'no copyright images' rule always seem to contradict itself because  the admins always seem to let several screenshots, recolors and photomanipulations based off copyrighted characters be posted on there every single day.

Internet trolls like the ones we've dealt with tend to think in that exact same mindset and think fan-art and fan-fiction are 'copyright  infringement' and that 'influenced by '= Stolen from  something else'.  If that was the case..then Video Brinquedo should have gotten sued for knocking off Disney and Dreamworks ages ago.

I've got a copyright story to share with you all,   back when my friend Monstermaster13 was simply known as Drmusic2-1 on DA he didn't know the rules and he posted motivational pictures and photomanips using copyrighted images including several of actress Carmen Electra as a fem-grinch/She-Hulk type,  and naturally the almighty admins showed up in their snobbish glory and totally called him out for it,  luckily though he took several of those down including the werejohncandy photomanips.  For the record the ones of Chumsley and Cassie were already photomanips to begin with,  since they were both made from a photomanip of Britney Spears in her 'Hit Me Baby One More Time/Oops I Did It Again' era as a BBW.  But did that stop trolls from making fun of him for those photomanips? Noooo... it didn't. They came crashing in harassing him and accusing him of copyright infringement without knowing what it means. And yet even now half of them have been banned,  the head troll in general's works can still be seen if you look them up.  You'd figure the admins would have known better  than to let some  schmuckhead troll and  their stupid friends harrass him, but apparently their so  called leader at the time was a troll too.  How on  earth do you make an  internet troll an admin?  That's just stupid. That's  like making a serial killer  vice president.  Also shouldn't the helpdesk be a bit more helpful and actually do something about the journals  that said troll that harassed him did that are still up there?

Did the admins miss this one entirely?  Banned means banned,  as in gone from the site completely,  hasta la vista baby,  goodbye,  see you never again NOT 'The account is gone but their work still exists'.  Do something for once and delete those would you? Oh..sure...use the  'just ignore it' response,  i'm sure that will NEVER backfire or kick you in the ass  later.

To me that just shows that they're either acting like a bunch of dickheads on  purpose just to screw with us or are too damn lazy to do their own jobs.  Either  that or they have let power go entirely into their head and became despots.  Same with Youtube, I think they're just letting it go all to their heads and they're  becoming mad with power. It's sad really.  It breaks my heart to see good websites go bad like that.

Luckily with Deviantart,  you can always just use stock you find on there or put  anything you made on something like Heromachine or IMVU on scraps,  that's where they're supposed to go.  But with Youtube..oh boy.   Let me tell you...it's a nightmare.

My friend Monstermaster13 did a video tribute - sort of - to Russell Brand using music from Tim Burton movies,   in particular Edward Scissorhands and Beetlejuice.  No clips of Brand were actually used but he was asked to change the music. I guess he got a copyright warning thing from Fox and Warner Bros since those companies produced said movies and all. So he took down the video.  If they're going to throw a hissy-fit over the music he used in his video,  then he might as well just move the video to  Vimeo.

The same happened when he did a satirical video about me using Michael Jackson's song Heal The World.   Again...sort of understandable,  but still...it's Sony.  And given how they treated Michael in general.  It's no surprise.  But out of all the songs he switched with it...i'm glad it's something classical and not something generic unlike the rest of the choices for music replacements.

That's why it's so damn hard to find good music to use in videos.  Because chances are, you're going to get complaints from the  copyright nazi patrol no matter what you choose and it just won't end.  Except if you  use something like Ren and Stimpy/Spongebob Production music or video game music.  

Allow me to educate these people on what copyright infringement is,   copyright infringement is only qualified as that if you are making money off the work of other people or stealing someone's use trademark,  on DA circles that is called 'art-theft' on occasion, but even than the admins tend to think that they're both the same thing.  It technically is NOT copyright infringement unless you are making money off of it, and also..being influenced/inspired by something doesn't mean the same thing as outright ripping it off completely.  Because influence is an entirely different thing.  For example,  my style of ranting is influenced by Ben T.Looney but you can't say i'm knocking him off in anyway because it's just influence and I have a different style.   Sure,  at times it may seem i've got a bit of a Dennis Miller influence but I don't outright knock him off or try to copy him,  I just am very opinionated like him.

When clips and music from movies or tv show is used in a video for the purpose of review or satire or for music videos..it is 'fair use',  the same goes for documentaries that use footage from said movie or show as well.  It's fair use. Doug Walker has done an excellent video on this sort of thing, I suggest you watch it.   Remember,  if it's for review, satire,  research or educational purposes...it's fair use.   Which is perfectly fine and is legal.  Like I said...the copyright nazis on sites like Deviantart and Youtube need to cool their jets and to stop acting like pricks. I mean look at what happened to the likes of I Hate Everything.  Seriously who let these pricks control who or what is allowed on the site?  They're about as competent as forum admins are.  And most forum admins are  either power-mad dictator wannabes,  two-faced doublecrossing cowards with disgusting fetishes, or complete assholes who feel the need to ban people from their forums for no reason.  I'm sorry Mr J.Q Admin,  but just because a certain user posted jokey comments on a forum thread about something they wanted to have deleted for a long time even said thing has been deleted by you  - doesn't mean they were being rude to you.   Can't you take a joke?

The point is...Youtube, cool it with the copyright complaints,  PLEASE! I'm talking to you in particular Fox,  Viacom, Hasbro and Universal - you too,  Disney.   All four of these companies need to lay off the copyright  claims .  Oh and Disney should definitely fire Kenny Ortega as well.   Dear Youtube,  this is earth..HAVE WE MET?

These copyright claims and misunderstandings of the word 'fair use' must stop.  This has gone too far.    It has gotten to the point that people would rather upload their videos elsewhere than on Youtube and that's something that you DON'T  want happening to you, nope  -  not at all.   So...my question is where the hell is the fair use?  The hollywood system is totally screwed and you know it.  I mean remember what happened due to CISPA and SOPA?  And don't forget Derek Savage aka the CWC of Bad Movie Producers.   As I mentioned, it's perfectly fine and legal to use copyrighted clips and scenes from movies and shows for educational, research, review or satirical purposes.    The Youtube system as a whole is completely trucked up.  They really need to get their act together...at once.

I could go on and  on but I believe that  Doug said it best.  These people need to get off their high horse and do something about this mess.  It is completely messed up and it needs to be fixed. It's bad enough that people mirror other people's work on here for lulzy purposes but this whole thing is made even worse considering what's going on right now.  We need to tell these people that what they are  doing is wrong and that they are misinterpreting  what fair use actually is.  If it's used for reviews,  satire, research or educational purposes - it's fair use and legal,  but if someone is just  mirroring the video just with a different filter or whatever...then that is the opposite.

These are difficult times,  my friends. In which we all need to stick together and show these people that they are acting irrational about this.  And that they don't know  that they're making a huge mistake by attempting to destroy what many OL reviewers and the like have worked hard to accomplish.   We need to show these losers the errors of their ways and to put an end to this tyranny before another good Youtuber falls victim to this.  We need to stand tall in these difficult times.
